Article R153-3 of the French Commercial code

On pain of inadmissibility, the party or third party to the proceedings who invokes the protection of business secrecy for a document whose communication or production is requested shall provide the judge, within the time limit set by the judge:

1° The full confidential version of the document;

2° A non-confidential version or a summary;

3° A statement specifying, for each item of information or part of the document in question, the reasons why it is a business secret;

The judge may hear the holder of the document separately.
The judge may hear separately the holder of the document, assisted or represented by any authorised person, and the party requesting the communication or production of this document.

Article R153-3

A peine d’irrecevabilité, la partie ou le tiers à la procédure qui invoque la protection du secret des affaires pour une pièce dont la communication ou la production est demandée remet au juge, dans le délai fixé par celui-ci :

1° La version confidentielle intégrale de cette pièce ;

2° Une version non confidentielle ou un résumé ;

3° Un mémoire précisant, pour chaque information ou partie de la pièce en cause, les motifs qui lui confèrent le caractère d’un secret des affaires.

Le juge peut entendre séparément le détenteur de la pièce, assisté ou représenté par toute personne habilitée, et la partie qui demande la communication ou la production de cette pièce.
