The judge shall order the communication or production of the document in its full version where this is necessary for the resolution of the dispute, even though it is likely to infringe a business secret.
In the latter case, the judge designates the person or persons who may have access to the full version of the document. Where one of the parties is a legal entity, he shall designate, after obtaining its opinion, the natural person or persons who, in addition to the persons authorised to assist or represent the parties, may have access to the document.

Le juge ordonne la communication ou la production de la pièce dans sa version intégrale lorsque celle-ci est nécessaire à la solution du litige, alors même qu’elle est susceptible de porter atteinte à un secret des affaires.


Dans ce dernier cas, le juge désigne la ou les personnes pouvant avoir accès à la pièce dans sa version intégrale. Lorsqu’une des parties est une personne morale, il désigne, après avoir recueilli son avis, la ou les personnes physiques pouvant, outre les personnes habilitées à assister ou représenter les parties, avoir accès à la pièce.
