Article R1611-34 of the French General Code of Local Authorities

I. – Local authorities, their groupings and departmental fire and rescue services may only enter into financial contracts provided that they are backed by loans and that the variable interest rate of the indexation formula resulting from the combination of the loan and the financial contract does not derogate from the conditions set out in Article R. 1611-33.

II. – The deliberation of the deliberative assembly or, in the event of delegation by the deliberative assembly, the decision of the executive to proceed with the subscription of a financial contract mentions the essential characteristics of the financial contract as well as the loan contract to which it is backed and states that the combination of the two contracts complies with the conditions set out in I of this article.

I. – Les collectivités territoriales, leurs groupements et les services départementaux d’incendie et de secours ne peuvent souscrire des contrats financiers qu’à condition qu’ils soient adossés à des emprunts et que le taux d’intérêt variable de la formule d’indexation qui résulte de la combinaison de l’emprunt et du contrat financier ne déroge pas aux conditions énoncées à l’article R. 1611-33.

II. – La délibération de l’assemblée délibérante ou, en cas de délégation de l’assemblée délibérante, la décision de l’exécutif de procéder à la souscription d’un contrat financier mentionne les caractéristiques essentielles du contrat financier ainsi que le contrat d’emprunt auquel il est adossé et constate que la combinaison des deux contrats respecte les conditions fixées au I du présent article.
