Without prejudice to the provisions of the eighth and ninth paragraphs of Article L. 1614-8-1, the compensation paid each year by the State is revised when a reorganisation of regional passenger services is made necessary by a change to services of national interest linked to the commissioning of a new infrastructure or to a modernisation operation that has been the subject of a ministerial approval decision.
The revision is based on a joint assessment by the State, the region and SNCF of the nature of the services of national interest that are being withdrawn. Trains providing both a service of national interest and a service of regional interest are taken into account in this assessment solely on the basis of journeys made in both capacities, as long as these trains serve at least two medium-sized towns in the region or one medium-sized town in the region and a neighbouring region, or where there is no other train of national or regional interest able to provide an equivalent service at peak times less than thirty minutes apart. For the application of these provisions, a medium-sized town is considered to be any town which is the administrative centre of an arrondissement and any town whose population is at least equal to the average population of the towns in the region which have a sub-prefecture.
Revised compensation is set in accordance with the procedures set out in article R. 1614-112. It is calculated on the basis of the cost, including capital charges, directly attributable to the implementation of the additional regional service required to provide a service equivalent to that of the cancelled trains, and taking into account the revenue corresponding to the new traffic estimated jointly by the region and SNCF.
