Article R162-44 of the French Public Health Code

Subject to having been approved under the conditions provided for in 7° of this article, the multidisciplinary centre for prenatal diagnosis of the territorial public health establishment of Mayotte has the task of giving an advisory opinion in the case of voluntary terminations of pregnancy envisaged on the grounds that there is a strong probability that the child to be born will suffer from a particularly serious condition recognised as incurable at the time of diagnosis:

1° The multidisciplinary team of the multidisciplinary prenatal diagnosis centre is set up within the Mayotte territorial public health establishment. It is made up of practitioners working in the territorial public health establishment in Mayotte, including at least one doctor qualified in gynaecology-obstetrics, one practitioner with experience in foetal ultrasound and one doctor with experience in paediatrics. This team may include other people with skills or qualifications that are useful in carrying out its tasks;

2° The role of this multidisciplinary team is to propose additional investigations or recourse to specialist external advice if it is necessary to support the attending doctor’s diagnosis or prognosis. It informs the doctor or patient of the possible therapeutic options and, if necessary, suggests that they be referred to specialised structures. These proposals and opinions are presented to the patient or the attending doctor by one or more members of the multidisciplinary team, after consultation within the team;

3° At the woman’s request, a doctor chosen by her will be involved in the multidisciplinary team consultation provided for in article L. 2213-1 ;

4° Prior to the meeting of this multidisciplinary team, the woman concerned or the couple is heard, at her request, by all or some of the members of the said team;

5° If, at the end of the consultation provided for in article L. 2213-1, it appears to two of the doctors on the multidisciplinary team that there is a strong probability that the unborn child will suffer from a particularly serious condition recognised as incurable at the time of diagnosis, and if the pregnant woman so requests, they will draw up, after the team has given its advisory opinion, the certificates provided for in article L. 2213-1. These certificates include the names and signatures of the doctors. A copy of the certificates is given to the person concerned;

6° The territorial public health establishment of Mayotte keeps, for each request, the opinion relating to a pregnancy in progress, the elements of the medical file, the opinions, advice and conclusions of the multidisciplinary team, the date of the voluntary interruption of pregnancy for medical reasons and, where applicable, the results of the examinations carried out at the request of the multidisciplinary team;

7° Approval for the multidisciplinary prenatal diagnosis centre is granted for a period of 5 years by a decision of the Minister for Health taken after a reasoned opinion from the prenatal diagnosis section of the national commission for reproductive medicine and biology and prenatal diagnosis, which takes particular account of the training, skills and experience of the practitioners making up the multidisciplinary team provided for below and the centre’s operating procedures. The annex to the approval decision lists the names of the practitioners making up the multidisciplinary team. Renewal of approval is granted under the same conditions, taking into account the results of the evaluation of the centre’s activity. The application for approval is submitted by the director of the Mayotte territorial public health establishment. It is accompanied by a dossier, the content of which is defined by order of the Minister for Health, which includes in particular the names of the practitioners who will make up the centre’s multidisciplinary team and its internal regulations. The centre’s approval may be withdrawn by a reasoned decision of the Minister for Health after consultation with the National Commission for Reproductive Medicine and Biology and Prenatal Diagnosis.

Sous réserve d’avoir été agréé dans les conditions prévues au 7° du présent article, le centre pluridisciplinaire de diagnostic prénatal de l’établissement public de santé territorial de Mayotte a pour mission de donner un avis consultatif dans le cas des interruptions volontaires de grossesse envisagées au motif qu’il existe une forte probabilité que l’enfant à naître soit atteint d’une affection d’une particulière gravité reconnue comme incurable au moment du diagnostic :

1° L’équipe pluridisciplinaire du centre pluridisciplinaire de diagnostic prénatal est constituée au sein de l’établissement public de santé territorial de Mayotte. Elle est composée de praticiens exerçant une activité dans l’établissement public de santé territorial de Mayotte dont au moins un médecin qualifié en gynécologie-obstétrique, un praticien ayant une expérience en échographie du foetus et un médecin ayant une expérience en pédiatrie. Cette équipe peut s’adjoindre d’autres personnes possédant des compétences ou des qualifications utiles à l’exercice de ses missions ;

2° Cette équipe pluridisciplinaire a pour mission de proposer des investigations complémentaires ou le recours à des avis extérieurs spécialisés s’il y a lieu d’étayer le diagnostic ou le pronostic du médecin traitant. Elle indique à ce médecin ou à la patiente les éventuelles possibilités de prise en charge thérapeutique et leur propose, le cas échéant, une orientation vers des structures spécialisées. Ces propositions et avis sont présentés à la patiente ou au médecin traitant par un ou plusieurs membres de l’équipe pluridisciplinaire, après concertation au sein de celle-ci ;

3° A la demande de la femme, un médecin choisi par elle est associé à la concertation de l’équipe pluridisciplinaire prévue à l’article L. 2213-1 ;

4° Préalablement à la réunion de cette équipe pluridisciplinaire, la femme concernée ou le couple est entendu, à sa demande, par tout ou partie des membres de ladite équipe ;

5° Si, au terme de la concertation prévue à l’article L. 2213-1, il apparaît à deux des médecins de l’équipe pluridisciplinaire qu’il existe une forte probabilité que l’enfant à naître soit atteint d’une affection d’une particulière gravité reconnue comme incurable au moment du diagnostic, et si la femme enceinte en fait la demande, ceux-ci établissent, après que l’équipe a rendu son avis consultatif, les attestations prévues à l’article L. 2213-1. Ces attestations comportent les noms et les signatures des médecins. Un exemplaire des attestations est remis à l’intéressé ;

6° L’établissement public de santé territorial de Mayotte conserve, pour chaque demande, l’avis relatif à une grossesse en cours, les éléments du dossier médical, les avis, conseils et conclusions de l’équipe pluridisciplinaire, la date de l’interruption volontaire de grossesse pour motif médical et, le cas échéant, le résultat des examens pratiqués à la demande de l’équipe pluridisciplinaire ;

7° L’agrément du centre pluridisciplinaire de diagnostic prénatal est donné pour une durée de 5 ans par décision du ministre chargé de la santé prise après avis motivé de la section du diagnostic prénatal de la commission nationale de médecine et de biologie de la reproduction et du diagnostic prénatal, qui tient compte notamment de la formation, de la compétence et de l’expérience des praticiens composant l’équipe pluridisciplinaire prévue ci-dessous et des modalités de fonctionnement du centre. La décision d’agrément indique, en annexe, le nom des praticiens composant l’équipe pluridisciplinaire. Le renouvellement de l’agrément est accordé dans les mêmes conditions en tenant compte, en outre, des résultats de l’évaluation de l’activité du centre. La demande d’agrément est présentée par le directeur de l’établissement public de santé territorial de Mayotte. Elle est accompagnée d’un dossier dont le contenu est défini par arrêté du ministre chargé de la santé qui comporte notamment le nom des praticiens qui composeront l’équipe pluridisciplinaire de ce centre et son règlement intérieur. L’agrément du centre peut être retiré par une décision motivée du ministre chargé de la santé après avis de la Commission nationale de médecine et de biologie de la reproduction et du diagnostic prénatal.
