Article R189 of the French Code of Criminal Procedure

Premiums are awarded to law enforcement officers under the conditions set out in articles R. 190 and R. 191 when there has been forced execution and the arrest has required duly recorded special searches.

There is no need to distinguish, from the point of view of entitlement to the allowance, according to whether the officer who carried out the arrest was the bearer of the warrant or extract of the judgment or arrest or had merely been advised of the existence of this document by a circular or an insertion in a police bulletin.

Only the highest gratuity is awarded if the accused or convicted person was the subject of several warrants, committal orders, judgments or sentences.

Des primes sont allouées aux agents de la force publique dans les conditions fixées aux articles R. 190 et R. 191 lorsqu’il y a eu exécution forcée et que l’arrestation a nécessité des recherches spéciales dûment constatées.

Il n’y a pas lieu de distinguer, au point de vue du droit à l’allocation, suivant que l’agent qui a opéré l’arrestation était porteur du mandat ou de l’extrait de jugement ou d’arrêt ou avait été simplement avisé de l’existence de cette pièce par une circulaire ou par une insertion à un bulletin de police.

La gratification la plus élevée est seule accordée si le prévenu, accusé ou condamné était sous le coup de plusieurs mandats, ordonnances de prise de corps, arrêts ou jugements de condamnations.
