Article R198 of the French Code of Criminal Procedure

Any judicial officer who refuses to act in proceedings taken at the request of the public prosecutor or to perform the service to which he is obliged before the court or tribunal and who, after an injunction made to him by the public prosecutor or the public prosecutor, persists in his refusal, shall be dismissed, without prejudice to any damages and other penalties he may have incurred.

Tout huissier de justice qui refusera d’instrumenter dans une procédure suivie à la requête du ministère public ou de faire le service auquel il est tenu près la cour ou le tribunal et qui, après injonction à lui faite par le procureur général ou le procureur de la République, persistera dans son refus, sera destitué, sans préjudice de tous dommages-intérêts et des autres peines qu’il aura encourues.
