Article R212-6-1 of the French Cinema and Moving Image Code

When a cinema development project is planned for the territory of several municipalities or cantons, the municipality or canton in which the project is to be implemented is deemed to be the municipality or canton in whose territory the largest proportion of the total surface area of all the cinemas for which authorisation is requested is located.

The mayor of the municipality in which the project is to be implemented may not sit on the committee in any capacity other than that of representative of his municipality. The same applies to the mayor of the most populous municipality in the arrondissement or multi-municipal conurbation when this is not the municipality in which the site is located.

When the municipality in which the site is located is part of a public establishment for inter-municipal cooperation with competence for spatial planning and development, this establishment is represented by its president or by a member of the community council designated by the president. The chair of this establishment may not be represented by an elected representative of the municipality in which the site is located, nor by an elected representative of the most populous municipality in the arrondissement or multi-municipal conurbation, where this is not the municipality in which the site is located.

Where the municipality in which the site is located is part of a public establishment with competence for territorial coherence schemes, this establishment is represented by its chair or by a member of the community council appointed by the chair. The president of this establishment may not be represented by an elected representative of the municipality in which the site is located, nor by an elected representative of the most populous municipality in the arrondissement or multi-municipal conurbation, where this is not the municipality in which the site is located.

The president of the departmental council or, in Corsica, the president of the executive council may not be represented by an elected representative of the commune in which the facility is located, nor by an elected representative of the most populous commune in the arrondissement or multi-communal conurbation if this is not the commune in which the facility is located.

When the mayor of the commune in which the site is located, the mayor of the most populated commune in the arrondissement or multi-communal agglomeration when this is not the commune in which the site is located, the president of the departmental council or, in Corsica, the President of the Executive Council or the President of the public body responsible for the Territorial Coherence Scheme is also the Departmental Councillor for the canton in which the project is located or, in Corsica, a Councillor at the Corsican Assembly, the Prefect appoints the Mayor of a municipality located in the area of cinematographic influence of the project as defined in article R. 212-7-1.

Lorsqu’un projet d’aménagement cinématographique est envisagé sur le territoire de plusieurs communes ou de plusieurs cantons, est considéré comme la commune ou le canton d’implantation celle ou celui dont le territoire accueille la plus grande partie des surfaces de l’ensemble de salles de spectacles cinématographiques faisant l’objet de la demande d’autorisation.

Le maire de la commune d’implantation ne peut pas siéger à la commission en une autre qualité que celle de représentant de sa commune. Il en est de même du maire de la commune la plus peuplée de l’arrondissement ou de l’agglomération multicommunale lorsque celle-ci n’est pas la commune d’implantation.

Lorsque la commune d’implantation fait partie d’un établissement public de coopération intercommunale compétent en matière d’aménagement de l’espace et de développement, cet établissement est représenté par son président ou par un membre du conseil communautaire désigné par le président. Le président de cet établissement ne peut pas être représenté par un élu de la commune d’implantation ni par un élu de la commune la plus peuplée de l’arrondissement ou de l’agglomération multicommunale lorsque celle-ci n’est pas la commune d’implantation.

Lorsque la commune d’implantation fait partie d’un établissement public compétent en matière de schéma de cohérence territoriale, cet établissement est représenté par son président ou par un membre du conseil communautaire désigné par le président. Le président de cet établissement ne peut pas être représenté par un élu de la commune d’implantation ni par un élu de la commune la plus peuplée de l’arrondissement ou de l’agglomération multicommunale lorsque celle-ci n’est pas la commune d’implantation.

Le président du conseil départemental ou, en Corse, le président du conseil exécutif ne peut pas être représenté par un élu de la commune d’implantation ni par un élu de la commune la plus peuplée de l’arrondissement ou de l’agglomération multicommunale lorsque celle-ci n’est pas la commune d’implantation.

Lorsque le maire de la commune d’implantation, le maire de la commune la plus peuplée de l’arrondissement ou de l’agglomération multicommunale lorsque celle-ci n’est pas la commune d’implantation, le président du conseil départemental ou, en Corse, le président du conseil exécutif ou le président de l’établissement public compétent en matière de schéma de cohérence territoriale est en même temps conseiller départemental du canton d’implantation ou, en Corse, conseiller à l’assemblée de Corse, le préfet désigne pour remplacer ce dernier le maire d’une commune située dans la zone d’influence cinématographique du projet telle qu’elle est définie à l’article R. 212-7-1.
