Article R2135-1 of the French Public Health Code

In order to support children with neurodevelopmental disorders and make a diagnosis, the structures designated by order of the Director General of the Regional Health Agency will enter into an agreement with other establishments or services mentioned in the second paragraph of Article L. 2135-1. The purpose of this agreement is to organise the assessment and early intervention pathway for neurodevelopmental disorders and to set up a coordination and referral platform.

The health insurance covers the costs of the programmes mentioned in article L. 2135-1 prescribed for children under the age of twelve and for which the prescription has been validated by a doctor practising in the structure designated by the Director General of the Regional Health Agency or in a structure linked to it by the agreement mentioned in the previous paragraph.

The validation specifies whether the assessments and early interventions are carried out within a structure of the platform or, failing that, by one or more professionals practising outside these structures; in the latter case, the validation specifies the services included in the pathway.

The doctor may refuse to validate the prescription when the implementation of the decisions of the commission provided for in article L. 241-5 of the Code de l’Action Sociale et des Familles provides care equivalent to the pathway provided for in article L. 2135-1 of this Code, or if there is no significant difference in the child’s acquisition or development. In the latter case, the designated structure will contact the doctor who wrote the prescription and organise a new clinical examination with him/her.

Pour l’accompagnement des enfants présentant un trouble du neuro-développement et pour la réalisation d’un diagnostic, les structures désignées par arrêté du directeur général de l’agence régionale de santé passent une convention avec d’autres établissements ou services mentionnés au deuxième alinéa de l’article L. 2135-1. L’objet de cette convention est l’organisation du parcours de bilan et intervention précoce pour les troubles du neuro-développement et la constitution d’une plateforme de coordination et d’orientation.

L’assurance maladie prend en charge les parcours mentionnés à l’article L. 2135-1 prescrits pour les enfants de moins de douze ans et pour lesquels la prescription a été validée par un médecin exerçant dans la structure désignée par le directeur général de l’agence régionale de santé ou dans une structure liée à celle-ci par la convention mentionnée à l’alinéa précédent.

La validation précise si les bilans et interventions précoces sont réalisés au sein d’une structure de la plateforme ou, à défaut, par un ou plusieurs professionnels exerçant en dehors de ces structures ; dans ce second cas, la validation précise les prestations incluses dans le parcours.

Le médecin peut refuser de valider la prescription lorsque la mise en œuvre de décisions de la commission prévue à l’article L. 241-5 du code de l’action sociale et des familles permet une prise en charge équivalente au parcours prévu à l’article L. 2135-1 du présent code, ou en cas d’absence d’écart significatif des acquisitions ou du développement de l’enfant. Dans ce dernier cas, la structure désignée prend contact avec le médecin qui a rédigé la prescription et organise avec lui un nouvel examen clinique.
