Article R214-176-2 of the French Monetary and Financial Code

Articles R. 214-163, R. 214-164, R. 214-165, R. 214-166, R. 214-168, R. 214-169, R. 214-170 and R. 214-175 are applicable to groupements forestiers d’investissement, subject to the following adaptations:

1° In article R. 214-163 :

a) The first paragraph is replaced by the following paragraph: “The exchange and transfer of woodland and forests which forest investment funds may carry out, apart from transfers authorised by II of article L. 214-93, must comply with the following conditions:” ;

b) At the beginning of the last paragraph, the words: “III of Article R. 214-162” are replaced by the words: “I of Article R. 214-176-1”;

2° In Article R. 214-166, the first paragraph is replaced by the following provisions:

The forest assets held by a groupement forestier d’investissement are managed in accordance with one or more approved simple management plans referred to in Article L. 331-4-1 of the Forestry Code.

Article R214-176-2

Les articles R. 214-163, R. 214-164, R. 214-165, R. 214-166, R. 214-168, R. 214-169, R. 214-170 et R. 214-175 sont applicables aux groupements forestiers d’investissement, sous réserve des adaptations suivantes :

1° A l’article R. 214-163 :

a) Le premier alinéa est remplacé par l’alinéa suivant : ” Les opérations d’échange et de cession de bois et forêts auxquelles peuvent procéder les groupements forestiers d’investissement, en dehors des cessions autorisées par le II de l’article L. 214-93, respectent les conditions suivantes : ” ;

b) Au début du dernier alinéa, les mots : ” III de l’article R. 214-162 ” sont remplacés par les mots : ” I de l’article R. 214-176-1 ” ;

2° A l’article R. 214-166, le premier alinéa est remplacé par les dispositions suivantes :

Le patrimoine forestier détenu par un groupement forestier d’investissement est géré conformément à un ou à plusieurs plans simples de gestion agréés mentionnés à l’ article L. 331-4-1 du code forestier .
