If the limits stipulated in a of V of article L. 214-164 are exceeded for reasons beyond the control of the fonds commun de placement d’entreprise, its primary objective must be to rectify the situation, taking into account the interests of the shareholders or unit-holders.

Si un dépassement des limites prévues au a du V de l’article L. 214-164 intervient indépendamment de la volonté du fonds commun de placement d’entreprise, celui-ci doit avoir pour objectif prioritaire de régulariser cette situation en tenant compte de l’intérêt des actionnaires ou des porteurs de parts.
