Article R214-85 of the French Monetary and Financial Code

Notwithstanding article R. 214-83, the assets of a real estate investment company with variable capital may also include direct or indirect holdings in companies mentioned in 2° and 3° of the I of article L. 214-36 which do not meet the conditions set out in 2° and 3° of article R. 214-83, up to a limit of 20% of the real estate assets mentioned in 1° to 3° and 5° of the I of article L. 214-36.

Par dérogation à l’article R. 214-83, l’actif d’une société de placement à prépondérance immobilière à capital variable peut également comprendre des participations directes ou indirectes dans des sociétés mentionnées aux 2° et 3° du I de l’article L. 214-36 qui ne répondent pas aux conditions fixées aux 2° et 3° de l’article R. 214-83, dans la limite de 20 % des actifs immobiliers mentionnés aux 1° à 3° et au 5° du I de l’article L. 214-36.

Par dérogation à l’article R. 214-83, l’actif d’un fonds de placement immobilier peut également comprendre des participations directes ou indirectes dans des sociétés mentionnées au 3° du I de l’article L. 214-36 qui ne répondent pas aux conditions fixées aux 2° et 3° de l’article R. 214-83, dans la limite de 20 % des actifs immobiliers mentionnés aux 1° à 3° et au 5° du I de l’article L. 214-36.
