Article R2143-6 of the French Labour Code

In the absence of an agreement, the decision to withdraw the trade union delegate mandate provided for in the second paragraph of article L. 2143-11 is taken by the regional director of companies, competition, consumption, labour and employment.
If the Minister to whom an appeal is lodged remains silent for more than four months, the decision is deemed to have been rejected.

En l’absence d’accord, la décision de suppression du mandat de délégué syndical prévue au deuxième alinéa de l’article L. 2143-11 est prise par le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi.
Le silence gardé pendant plus de quatre mois par le ministre saisi d’un recours hiérarchique contre cette décision vaut décision de rejet.
