Article R2146-5 of the French Labour Code

Any director or manager of a trade union or union of trade unions who, contrary to the provisions of article L. 2141-1, opposes the free membership of an employee on the grounds of his or her sex, age, nationality, religion or beliefs, disability, sexual orientation or actual or assumed membership of an ethnic group or race, is liable to a fifth-class fine.
The same penalty shall be imposed for opposing the membership or continued membership of a person who has ceased professional activity, in breach of the provisions of article L. 2141-2.

Le fait pour un directeur ou un administrateur d’un syndicat ou d’une union de syndicats de s’opposer à la libre adhésion d’un salarié pour un motif lié à son sexe, son âge, sa nationalité, sa religion ou ses convictions, son handicap, son orientation sexuelle, son appartenance, vraie ou supposée à une ethnie ou une race, en méconnaissance des dispositions de l’article L. 2141-1, est puni de l’amende prévue pour les contraventions de la cinquième classe.
Est puni de la même peine le fait de s’opposer à l’adhésion ou à la poursuite de l’adhésion d’une personne ayant cessé d’exercer son activité professionnelle, en méconnaissance des dispositions de l’article L. 2141-2.
