Article R2151-5 of the French Public Health Code

Embryos may only be delivered to the person responsible for the research mentioned in Article R. 2151-8 by the holder of the authorisation provided for in Article L. 2151-9, by the practitioner approved in application of Article L. 2131-4-2 or by the practitioner working, in accordance with the fifth paragraph of Article L. 2142-1, in an establishment, laboratory or organisation authorised in application of the same article. The person responsible for the research must produce the authorisation for the research protocol. The holder of the authorisation or the practitioner must provide him/her with the document certifying that the consent referred to in article R. 2151-4 has been obtained.

No information likely to identify the couple, the unmarried woman or the surviving member of the couple at the origin of the embryos which are the subject of the research may be communicated to the person responsible for the research.

Les embryons ne peuvent être remis au responsable de la recherche mentionné à l’article R. 2151-8 que par le titulaire de l’autorisation prévue à l’article L. 2151-9, par le praticien agréé en application de l’article L. 2131-4-2 ou par le praticien intervenant, conformément au cinquième alinéa de l’article L. 2142-1, dans un établissement, laboratoire ou organisme autorisé en application du même article. Le responsable de la recherche doit produire l’autorisation du protocole de recherche. Le titulaire de l’autorisation ou le praticien lui remet le document attestant du recueil des consentements mentionné à l’article R. 2151-4.

Aucune information susceptible de permettre l’identification du couple, de la femme non mariée ou du membre survivant du couple à l’origine des embryons faisant l’objet de la recherche ne peut être communiquée au responsable de la recherche.
