Article R218 of the French Code of Criminal Procedure

The costs in respect of protective measures taken after the opening of an estate shall be borne by the estate and recovery thereof shall be pursued in accordance with the procedures and under the guarantees provided in respect of criminal fines.

The bailiff appointed pursuant to the provisions of Article 1306 of the Code of Civil Procedure shall inform the clerk’s office of the name and address of the person or persons called to the inventory at the latest when submitting his statement of costs for the unsealing.

He shall attach to this statement a recapitulative statement of the costs incurred since his appointment, specifying those for which he has already requested an advance from the Treasury.

Les frais en matière de mesures conservatoires prises après l’ouverture d’une succession sont à la charge de celle-ci et le recouvrement en est poursuivi selon les procédures et sous les garanties prévues en matière d’amende pénale.

L’huissier désigné en application des dispositions de l’article 1306 du code de procédure civile indique au greffe le nom et l’adresse de la ou des personnes appelées à l’inventaire au plus tard lors de la présentation de son mémoire de frais pour la levée de scellés.

Il joint à ce mémoire un état récapitulatif des frais engagés depuis sa désignation, en précisant ceux pour lesquels il a déjà demandé une avance au Trésor.
