Article R221-32 of the French Code of civil enforcement procedures

The price of the sale is paid into the hands of the distraining creditor’s bailiff, who issues a receipt to which is attached an extract of the entries in the register referred to in article R. 521-1 of the French Commercial Code, which has been lifted in accordance with article R. 221-14-1.

The transfer of ownership and the delivery of the goods are subject to payment of the price.

On proof of payment of the price, the entries of the securities taken over the goods sold on behalf of the distraining debtor are cancelled.

If payment is not made within the agreed period, the sale shall be forced.

Le prix de la vente est versé entre les mains de l’huissier de justice du créancier saisissant, qui en délivre récépissé auquel est annexé un extrait des inscriptions au registre mentionné à l’article R. 521-1 du code de commerce levé en application de l’article R. 221-14-1.


Le transfert de la propriété et la délivrance des biens sont subordonnés au paiement du prix.


Il est procédé, sur justification du paiement du prix, à la radiation des inscriptions de sûretés prises sur les biens vendus du chef du débiteur saisi.


A défaut de paiement dans le délai convenu, il est procédé à la vente forcée.
