Article R221-98 of the French Monetary and Financial Code

To be authorised to open youth passbooks, the establishments and organisations mentioned in article R. 221-76 must first sign an authorisation agreement with the State setting out their commitments. The competent administrative authority signs this agreement on behalf of the State.

This agreement specifies, in particular, the procedures for setting up an information system to identify depositors. It also specifies the procedures for allocating the funds deposited in compliance with the provisions of the order provided for in article R. 221-100.

Pour être autorisés à ouvrir des livrets jeunes, les établissements et organismes mentionnés à l’article R. 221-76 doivent préalablement conclure une convention d’habilitation avec l’Etat fixant leurs engagements. L’autorité administrative compétente signe cette convention au nom de l’Etat.

Cette convention précise, notamment, les modalités d’établissement d’un système d’information permettant l’identification des déposants. Elle précise également les modalités d’affectation des fonds déposés dans le respect des dispositions de l’arrêté prévu à l’article R. 221-100.
