Article R223 of the French Code of Criminal Procedure

The court with jurisdiction to deal with the statement or memorandum of legal costs is the court that prescribed the measure.

However, the judicial court has jurisdiction to deal with the statement or memorandum relating to legal costs incurred in the course of proceedings before a judicial court or industrial tribunal located within its jurisdiction.

The Secretary General of the Ministry of Justice has jurisdiction to deal with memoranda relating to the costs provided for in 9° of Article R. 92 when the requisition has been transmitted by the national platform for judicial interceptions to the operator.

The statements of costs of a bailiff come under the jurisdiction of the court of appeal or the judicial court in whose jurisdiction the bailiff has his residence depending on the nature of the court at the origin of his intervention.

La juridiction compétente pour traiter l’état ou le mémoire de frais de justice est celle qui a prescrit la mesure.

Toutefois, le tribunal judiciaire est compétent pour traiter l’état ou le mémoire relatif à des frais de justice engagés au cours d’une procédure devant un tribunal judiciaire ou un conseil de prud’hommes situé dans son ressort.

Le secrétaire général du ministère de la justice est compétent pour traiter les mémoires relatifs aux frais prévus au 9° de l’article R. 92 lorsque la réquisition a été transmise par la plate-forme nationale des interceptions judiciaires à l’opérateur.

Les états de frais d’un huissier de justice relèvent de la compétence de la cour d’appel ou du tribunal judiciaire dans le ressort duquel l’huissier a sa résidence selon la nature de la juridiction à l’origine de son intervention.
