Article R2314-24 of the French Labour Code

Challenges are referred to the judicial court by means of a petition.

Where the dispute relates to the electorate, the application is only admissible if it is delivered or sent within three days of publication of the electoral roll.

Where the challenge relates to a decision of the administrative authority, at the request of the court registry, the latter must provide proof that it has served notice of its decision on the court seised or, failing this, that it has received the challenge. If the court so requests, it must provide all the information specifying the legal or factual grounds on which its decision was based.

Where the dispute relates to the regularity of the election or appointment of trade union representatives, the application is only admissible if it is submitted or sent within fifteen days of the election or appointment.

Le tribunal judiciaire est saisi des contestations par voie de requête.

Lorsque la contestation porte sur l’électorat, la requête n’est recevable que si elle est remise ou adressée dans les trois jours suivant la publication de la liste électorale.

Lorsque la contestation porte sur une décision de l’autorité administrative, sur demande du greffe, cette dernière justifie de l’accomplissement de la notification de sa décision auprès de la juridiction saisie ou, à défaut, de sa réception de la contestation. Si le juge le demande, elle communique tous les éléments précisant les éléments de droit ou de fait ayant fondé sa décision.

Lorsque la contestation porte sur la régularité de l’élection ou sur la désignation de représentants syndicaux, la requête n’est recevable que si elle est remise ou adressée dans les quinze jours suivant cette élection ou cette désignation.
