The election of the members of the staff delegation of the social and economic committee may be carried out by electronic voting at the workplace or remotely.
Without prejudice to the provisions relating to the pre-electoral agreement protocol set out in articles L. 2314-5 et seq., the possibility of using an electronic vote is opened up by a company agreement or by a group agreement. In the absence of an agreement, the employer may decide to use this method, which may also be used for by-elections taking place during the term of office.
Specifications complying with the provisions of articles R. 2314-6 et seq. are drawn up within the framework of the agreement mentioned in the second paragraph or, failing this, by the employer.
The specifications are made available to employees in the workplace. It is posted on the company intranet where one exists.
The introduction of electronic voting does not prohibit voting by secret ballot in an envelope if the agreement or the employer does not exclude this method.
