The Regional Director of Companies, Competition, Consumption, Labour and Employment at the location of the company’s head office is responsible for allocating the seats between the different establishments and the different categories as provided for in the first paragraph of Article L. 2316-8. The Regional Director of Companies, Competition, Consumption, Labour and Employment takes his decision within two months of the referral. This decision is notified by registered letter with acknowledgement of receipt, indicating the appeal procedures and deadlines. It may be appealed before the judicial court within fifteen days of its notification.
In the event of an implicit rejection by the Regional Director of Companies, Competition, Consumption, Labour and Employment, the employer or the trade union organisations concerned may, within a period of fifteen days, refer the matter to the judicial court for a ruling on the allocation.
