Article R2321-1 of the French Labour Code

In the absence of an agreement as provided for in article L. 2321-2, each elected member of the Works Council taking part in a negotiation has a number of delegation hours which is added to the delegation hours from which he benefits in application of 1° of article L. 2315-7.

This cannot be less than:

-12 hours per month in companies with up to 149 employees;

-18 hours per month in companies with 150 to 499 employees;

-24 hours per month in companies with at least 500 employees.

Article R2321-1

A défaut d’accord prévu à l’article L. 2321-2, chaque élu du Conseil d’entreprise participant à une négociation dispose d’un nombre d’heures de délégation qui s’ajoute aux heures de délégation dont il bénéficie en application du 1° de l’article L. 2315-7.


Cette durée ne peut être inférieure à :


-12 heures par mois dans les entreprises jusqu’à 149 salariés ;


-18 heures par mois dans les entreprises de 150 à 499 salariés ;


-24 heures par mois dans les entreprises d’au moins 500 salariés.
