Article R2324-20 of the French Public Health Code

I.-The authorisation issued by the President of the Departmental Council indicates:

1° The name and company name of the legal entity managing the establishment or service;

2° The type of establishment or service in accordance with II of article R. 2324-17 ;

3° The capacity and category of the establishment or service in accordance with articles R. 2324-46, R. 2324-47 and R. 2324-48 ;

4° The age limits for children who may be accommodated;

5° The opening days and times;

6° Whether the person performing the duties of director, technical manager or technical adviser of the establishment also performs one of these duties for one or more other establishments in application of article R. 2324-34-2 or II of article R. 2324-46-5 ;

7° The management rule chosen by the establishment in application of II of article R. 2324-46-4 when the establishment comes under 1° of II of article R. 2324-17;

8° If it is a seasonal or one-off establishment as defined in article R. 2324-49 ;

9° If it is a parent-run establishment as defined in article R. 2324-50.

Subject to the application of III of article R. 2324-19, the authorisation also mentions the name of the director, the technical advisor or, in the case of parent-managed establishments, the technical manager.

Irrespective of the application of the provisions of article R. 2324-27, the authorisation may provide for different reception capacities for different periods of the year, week or day, taking into account foreseeable variations in reception needs.

II – The authorisation sets out the requirements resulting from this Code that the establishment or service is obliged to meet with regard to its characteristics as indicated in I, as well as its actual opening date.

I.-L’autorisation délivrée par le président du conseil départemental indique :

1° Le nom et la raison sociale de la personne morale gérant l’établissement ou le service ;

2° Le type d’établissement ou de service selon le II de l’article R. 2324-17 ;

3° La capacité d’accueil et la catégorie de l’établissement ou du service selon les articles R. 2324-46, R. 2324-47 et R. 2324-48 ;

4° Les âges limites des enfants pouvant être accueillis ;

5° Les jours et horaires d’ouverture ;

6° Si la personne exerçant les fonctions de directeur, responsable technique ou référent technique de l’établissement exerce également l’une de ces fonctions pour un ou plusieurs autres établissements en application de l’article R. 2324-34-2 ou du II de l’article R. 2324-46-5 ;

7° La règle d’encadrement choisie par l’établissement en application du II de l’article R. 2324-46-4 lorsque l’établissement relève du 1° du II de l’article R. 2324-17 ;

8° S’il s’agit d’un établissement saisonnier ou ponctuel tel que défini à l’article R. 2324-49 ;

9° S’il s’agit d’un établissement à gestion parentale tel que défini à l’article R. 2324-50.

Sous réserve de l’application du III de l’article R. 2324-19, l’autorisation mentionne également le nom du directeur, du référent technique ou, pour les établissements à gestion parentale, du responsable technique.

Indépendamment de l’application des dispositions de l’article R. 2324-27, l’autorisation peut prévoir des capacités d’accueil différentes suivant les périodes de l’année, de la semaine ou de la journée, compte tenu des variations prévisibles des besoins d’accueil.

II.-L’autorisation rappelle les exigences résultant du présent code que l’établissement ou le service a obligation de respecter au regard de ses caractéristiques indiquées au I ainsi que sa date d’ouverture effective.
