Article R2324-34-1 of the French Public Health Code

The person managing an establishment or service shall specify in writing the powers and duties delegated to the professional whom it has entrusted with the management of the establishment or service.

A copy of this document is sent to the president of the departmental council of the department which issued the authorisation or gave the opinion provided for in articles R. 2324-20 and R. 2324-22 respectively, and, where applicable, to the board of the establishment or service.

The document specifies the nature and extent of the delegations, in particular with regard to :

1° Leading the definition and implementation of the establishment’s or service’s project ;

2° Leading and managing human resources;

3° Budgetary, financial and accounting management

4° Coordination with external institutions and stakeholders.

Article R2324-34-1

La personne gestionnaire d’un établissement ou d’un service précise par écrit les compétences et les missions confiées par délégation au professionnel qu’elle a chargé de la direction de l’établissement ou du service.

Une copie de ce document est adressée au président du conseil départemental du département qui a délivré l’autorisation ou donné l’avis prévus respectivement aux articles R. 2324-20 et R. 2324-22, ainsi que, le cas échéant, au conseil de l’établissement ou du service.

Le document précise la nature et l’étendue des délégations notamment en matière de :

1° Conduite de la définition et de la mise en oeuvre du projet d’établissement ou de service ;

2° Animation et gestion des ressources humaines ;

3° Gestion budgétaire, financière et comptable ;

4° Coordination avec les institutions et les intervenants extérieurs.
