Article R2324-49-1 of the French Public Health Code

The application for authorisation or opinion referred to in article R. 2324-18 is sent no later than three months before the planned opening date by electronic means in accordance with the procedures laid down by order of the Minister for the Family. The authorisation or opinion is valid for five years from the date of the first opening of the establishment.

Where the application is for renewal of the current authorisation, the on-site visit provided for in article R. 2324-23 may take place after the establishment or service has been opened to the public.

Each time the establishment is reopened during the authorisation period, and no later than one month before it is reopened, the manager of the establishment must inform the President of the Departmental Council of its plans to reopen in accordance with the procedures laid down by order of the Minister for the Family.

La demande d’autorisation ou d’avis mentionnée à l’article R. 2324-18 est transmise au plus tard trois mois avant la date d’ouverture envisagée de manière dématérialisée selon les modalités fixées par arrêté du ministre chargé de la famille. L’autorisation ou l’avis vaut pour cinq ans à compter de la date de la première ouverture de l’établissement.

Lorsque la demande tend au renouvellement de l’autorisation en cours, la visite sur place prévue à l’article R. 2324-23 peut avoir lieu après l’ouverture de l’établissement ou du service au public.

Lors de chaque réouverture au cours de la période d’autorisation, et au plus tard un mois avant la réouverture de l’établissement, le gestionnaire de l’établissement informe le président du conseil départemental de son projet de réouverture selon des modalités fixées par arrêté du ministre chargé de la famille.
