Article R2324-50-1 of the French Public Health Code

I.-In parent-managed establishments or services, the person exercising the management functions provided for in article R. 2324-34 is called the “technical manager”.

In the absence of the person usually responsible for the functions of technical manager, the continuity of these functions is ensured by a person present in the establishment or service, falling under 1° or 2° of article R. 2324-42 and having professional experience with young children.

Exceptionally, this professional may be replaced by a parent who is regularly involved in the care of the children, provided that this possibility is specified in the operating rules.

II – The operating rules provided for in article R 2324-30 specify the procedures for appointing the technical manager and the conditions under which he or she will deputise. They define the respective responsibilities and cooperation arrangements of the holders of parental authority or legal representatives and the professionals responsible for supervising the children.

I.-Dans les établissements ou services à gestion parentale, la personne exerçant les fonctions de direction prévues à l’article R. 2324-34 est appelée “ responsable technique ”.

En l’absence de la personne habituellement chargée des fonctions de responsable technique, la continuité de ces fonctions est assurée par une personne présente dans l’établissement ou service, relevant du 1° ou du 2° de l’article R. 2324-42 et disposant d’une expérience professionnelle auprès de jeunes enfants.

Exceptionnellement, ce professionnel peut être remplacé par un parent participant régulièrement à l’accueil des enfants, sous réserve que cette possibilité soit précisée dans le règlement de fonctionnement.

II.-Le règlement de fonctionnement prévu à l’article R 2324-30 précise les modalités de désignation du responsable technique et les conditions dans lesquelles sa suppléance est assurée. Il définit les responsabilités respectives et les modalités de collaboration des titulaires de l’autorité parentale ou représentants légaux et des professionnels assurant l’encadrement des enfants.
