Article R2364-1 of the French Labour Code

The president of the judicial court of the place where the registered office of the European Cooperative Society is located shall rule in accordance with the accelerated procedure on the merits of all disputes relating to the application of article L. 2364-3 insofar as it refers to article L. 2354-4.

It shall order the constitution of a special negotiation body if the composition of the works council of the European Cooperative Society or the arrangements for employee involvement no longer correspond to the number of employees or the structure of the company.

Article R2364-1

Le président du tribunal judiciaire du lieu du siège de la société coopérative européenne statue selon la procédure accélérée au fond sur toutes les contestations relatives à l’application de l’article L. 2364-3 en ce qu’il renvoie à l’article L. 2354-4.

Il ordonne la constitution d’un groupe spécial de négociation si la composition du comité de la société coopérative européenne ou les modalités d’implication des salariés ne correspondent plus à l’effectif ou à la structure de la société.
