Article R24 of the French Code of Criminal Procedure

Under Article 138, the investigating judge may order the person under investigation to set up, within a period that he or she determines, one or more personal or real sureties intended to guarantee the respective rights of identified or identifiable victims and the Public Treasury.

The judge sets the period for which the security must be provided and the amount of the sum thus guaranteed. Where there are several identified or identifiable victims, he may specify for each the amount of the sum guaranteed by the security.

In the case of a security in rem, the judge also designates the assets constituting the basis of the security, the nature of the security and specifies, where applicable, its ranking.

En application du 15° de l’article 138, le juge d’instruction peut ordonner à la personne mise en examen de constituer, dans un délai qu’il détermine, une ou plusieurs sûretés personnelles ou réelles destinées à garantir les droits respectifs des victimes identifiées ou identifiables et du Trésor public.

Le juge fixe la durée pour laquelle la sûreté doit être constituée et le montant de la somme ainsi garantie. En présence de plusieurs victimes identifiées ou identifiables, il peut pour chacune préciser le montant de la somme garantie par la sûreté.

Lorsqu’il s’agit d’une sûreté réelle, le juge désigne, en outre, les biens constituant l’assiette de la sûreté, la nature de cette dernière et il précise, le cas échéant, son rang.
