Article R2421-10 of the French Labour Code

The request for authorisation to dismiss a member of the staff delegation on the social and economic committee or a local representative is sent to the labour inspector under the conditions defined in article L. 2421-3.

It is accompanied by the minutes of the Social and Economic Committee meeting.

Except in the case of a lay-off, the request is sent within fifteen days of the date on which the opinion of the social and economic committee was issued.

The request shall state the reasons for the proposed dismissal. It is sent by registered letter with acknowledgement of receipt.

Article R2421-10

La demande d’autorisation de licenciement d’un membre de la délégation du personnel au comité social et économique ou d’un représentant de proximité est adressée à l’inspecteur du travail dans les conditions définies à l’article L. 2421-3.

Elle est accompagnée du procès-verbal de la réunion du comité social et économique.

Excepté dans le cas de mise à pied, la demande est transmise dans les quinze jours suivant la date à laquelle a été émis l’avis du comité social et économique.

La demande énonce les motifs du licenciement envisagé. Elle est transmise par lettre recommandée avec avis de réception.
