Article R249-17 of the French Code of Criminal Procedure

The liberty and custody judge with jurisdiction to hear the appeal lodged on the basis of the article 803-8 by a person placed in pre-trial detention or extradition custody is that of the judicial court with jurisdiction to hear the proceedings concerning that person or the judicial court located at the seat of the court of appeal with jurisdiction to hear those proceedings.

The sentence enforcement judge with jurisdiction to hear an appeal lodged on the basis of Article 803-8 by a convicted person is that of the judicial court within whose jurisdiction the prison where that person is incarcerated is located or, in the case provided for by article 706-22-1, of the Paris judicial court.

Article R249-17

Le juge des libertés et de la détention compétent pour connaître du recours formé sur le fondement de l’article 803-8 par une personne placée en détention provisoire ou sous écrou extraditionnel est celui du tribunal judiciaire compétent pour connaître de la procédure concernant cette personne ou du tribunal judiciaire situé au siège de la cour d’appel compétente pour connaître de cette procédure.

Le juge de l’application des peines compétent pour connaître du recours formé sur le fondement de l’article 803-8 par une personne condamnée est celui du tribunal judiciaire dans le ressort duquel est situé l’établissement pénitentiaire où cette personne est incarcérée ou, dans le cas prévu par l’article 706-22-1, du tribunal judiciaire de Paris.
