Article R249-25 of the French Code of Criminal Procedure

Within ten days of the date on which the order declaring the application admissible was issued, the judge shall rule by reasoned order on the merits of the application in the light of the application and the observations of the detainee or, where applicable, his lawyer, the written observations of the prison administration and the written opinion of the examining magistrate, the public prosecutor or the public prosecutor.

Dans un délai de dix jours à compter de la date à laquelle a été rendue l’ordonnance déclarant la requête recevable, le juge se prononce par ordonnance motivée sur le bien-fondé de la requête au vu de celle-ci et des observations de la personne détenue ou, le cas échéant, de son avocat, des observations écrites de l’administration pénitentiaire et de l’avis écrit du juge d’instruction, du procureur de la République ou du procureur général.


L’avocat peut à tout moment prendre connaissance du dossier de la procédure.
