Article R2523-9 of the French Labour Code

In the case of a dispute with a regional, departmental or local impact, when the parties have been unable to agree on the choice of a mediator within three days of the request being filed, or when the procedure is initiated either by the chairman of the regional conciliation commission, or in the case of 2° of article R. 2523-4 by the Prefect, the latter, acting on a proposal from the Regional Director for Business, Competition, Consumer Affairs, Labour and Employment, appoints the mediator from among the persons appearing on the lists referred to in Article R. 2523-1.

Dans le cas d’un conflit à incidence régionale, départementale ou locale, lorsque les parties n’ont pu se mettre d’accord sur le choix d’un médiateur dans le délai de trois jours suivant le dépôt de la requête, ou lorsque la procédure est engagée soit par le président de la commission régionale de conciliation, soit dans le cas du 2° de l’article R. 2523-4 par le préfet, celui-ci, sur proposition du directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi, désigne le médiateur parmi les personnes figurant sur les listes mentionnées à l’article R. 2523-1.
