The Commission for the Protection of Access to Works comprises nine members:
1° One member of the Court of Cassation, nominated by the First President of the Court of Cassation, Chairman;
2° One member of the Council of State, nominated by the Vice-Chairman of the Council of State;
3° The Director General of Media and Cultural Industries or his representative;
4° The Director General of the Treasury or his representative;
5° One person qualified in the field of the production of cinematographic and audiovisual works;
6° A person qualified in the field of distribution of cinematographic and audiovisual works;
7° A person qualified in the management of authors’ interests;
8° A person qualified in the ownership and management of a catalogue of cinematographic or audiovisual works from a company subject to the obligation of ongoing exploitation research provided for inarticle L. 132-27 of the French Intellectual Property Code;
9° A person qualified in literary and artistic property law.
The chairman and members of the committee mentioned in 2°, 5°, 6°, 7°, 8° and 9° are appointed for a two-year term, renewable twice, by order of the Minister for Culture. Alternate members of the committee are appointed under the same conditions.
Unless it occurs less than three months before the expiry of the term of office, any vacancy, for whatever reason, or loss of the capacity in respect of which a member of the Commission was appointed, gives rise to the appointment of a new member to replace him/her for the remainder of the term of office. If this appointment is made less than one year before the expiry of the term of office, the replacement may serve a further three terms.
