Article R28 of the French Code of Criminal Procedure

As soon as the application is received, the clerk’s office of the court of appeal shall request from the clerk’s office of the court which handed down the decision to dismiss, acquit or acquit the case the file of the criminal proceedings or, if those proceedings are still pending in respect of persons other than the applicant, the copy of the file.

Within fifteen days of receipt of this file, the registry of the court of appeal shall send a copy of the request to the public prosecutor at the court of appeal and, by registered letter with acknowledgement of receipt, to the judicial agent of the State.

Dès la réception de la requête, le greffe de la cour d’appel demande au greffe de la juridiction qui a rendu la décision de non-lieu, de relaxe ou d’acquittement la communication du dossier de la procédure pénale ou, si cette procédure est toujours en cours en ce qui concerne d’autres personnes que le demandeur, de la copie du dossier.

Dans un délai de quinze jours à compter de la réception de ce dossier, le greffe de la cour d’appel transmet une copie de la requête au procureur général près la cour d’appel et, par lettre recommandée avec demande d’avis de réception, à l’agent judiciaire de l’Etat.
