Article R311-10 of the French Intellectual Property Code

II.-However, when a product is offered for sale to end users by means of a distance communication technique, or when it is offered for sale under physical conditions that do not allow it to be displayed, this information shall be brought to the attention of the purchaser in a precise manner by any means that can be proven, before the contract is concluded.

III.-When a recording medium is sold to a professional purchaser, the information provided for in article R. 311-9 appears at the bottom of the invoice. This information is then supplemented by a reference to the option of reimbursement of the remuneration paid on the occasion of the purchase.

I.-Dans un lieu de vente, l’information prévue à l’article R. 311-9 prend la forme d’un affichage clair et lisible à proximité du support concerné.

II.-Toutefois, lorsque la mise en vente est faite à destination d’utilisateurs finaux par une technique de communication à distance, ou lorsque la mise en vente a lieu dans des conditions matérielles ne permettant pas un affichage, cette information est portée à la connaissance de l’acquéreur de façon précise par tout moyen faisant preuve, avant la conclusion du contrat.

III.-Lorsqu’un support d’enregistrement est vendu à un acquéreur professionnel, l’information prévue à l’article R. 311-9 figure en pied de facture. S’ajoute alors à cette information la mention de la faculté de remboursement de la rémunération acquittée à l’occasion de l’achat.
