Article R3115-3 of the French Public Health Code

For the purposes of this Chapter and in accordance with the International Health Regulations (2005), the following definitions shall apply

1° Free circulation means permission for a ship to enter a port, to embark or disembark, unload or load cargo or stores; for an aircraft, permission, after landing, to embark or disembark, unload or load cargo or stores;

2° Point of Entry, a crossing point for the international entry or exit of travellers, baggage, cargo, containers, means of transport, goods and postal parcels, as well as the organisations and sectors providing services to them on entry or exit;

3° National focal point, the national centre which must be able to communicate with the contact points (RSI) at the World Health Organisation at all times;

4° Reservoir, an animal, plant or substance which normally harbours an infectious agent and whose presence may constitute a public health risk;

5° Public health risk, the likelihood of an event which may harm the health of human populations, more particularly an event which may spread internationally or present a serious and direct danger;

6° International traffic means the movement of persons, baggage, cargo, containers, means of transport, goods or postal parcels across an international border, including international trade;

7° Vector, an insect or any animal that normally carries an infectious agent constituting a risk to public health;

8° International travel:

a) In the case of a means of transport, a journey between points of entry situated in the territories of more than one State or a journey between points of entry situated in the territory or territories of the same State if, during its journey, the means of transport is in contact with the territory of any other State, but only for these contacts ;

(b) in the case of a traveller, a journey involving entry into the territory of a State other than the territory of the State from which the traveller departs.

Article R3115-3

Pour l’application du présent chapitre et conformément au règlement sanitaire international (2005), on entend par :

1° Libre pratique, l’autorisation pour un navire d’entrer dans un port, d’y procéder à l’embarquement ou au débarquement, au déchargement ou au chargement de cargaisons ou de provisions ; pour un aéronef, l’autorisation, après atterrissage, de procéder à l’embarquement ou au débarquement, au déchargement ou au chargement de cargaisons ou de provisions ;

2° Point d’entrée, un point de passage pour l’entrée ou la sortie internationales des voyageurs, bagages, cargaisons, conteneurs, moyens de transport, marchandises et colis postaux ainsi que les organismes et secteurs leur apportant des services à l’entrée ou à la sortie ;

3° Point focal national, le centre national qui doit être à tout moment à même de communiquer avec les points de contact (RSI) à l’Organisation mondiale de la santé ;

4° Réservoir, un animal, une plante ou une substance qui héberge normalement un agent infectieux et dont la présence peut constituer un risque pour la santé publique ;

5° Risque pour la santé publique, la probabilité d’un événement qui peut nuire à la santé des populations humaines, plus particulièrement d’un événement pouvant se propager au niveau international ou présenter un danger grave et direct ;

6° Trafic international, mouvement des personnes, bagages, cargaisons, conteneurs, moyens de transport, marchandises ou colis postaux qui traversent une frontière internationale, y compris des échanges commerciaux internationaux ;

7° Vecteur, un insecte ou tout animal qui véhicule normalement un agent infectieux constituant un risque pour la santé publique ;

8° Voyage international :

a) Dans le cas d’un moyen de transport, d’un voyage entre des points d’entrée situés sur les territoires de plus d’un Etat ou d’un voyage entre des points d’entrée situés sur le ou les territoires d’un même Etat si, pendant son voyage, le moyen de transport est en contact avec le territoire de tout autre Etat, mais uniquement pour ces contacts ;

b) Dans le cas d’un voyageur, d’un voyage comportant l’entrée sur le territoire d’un Etat autre que le territoire de l’Etat d’où part le voyageur.
