Article R3115-5 of the French Public Health Code

I. – The agents mentioned in article L. 3116-3 are authorised within the limits of their respective powers by order of the Prefect:

1° For employees of the Regional Health Agency, on the recommendation of their Director General ;

2° For employees of the State departments under its authority, on the recommendation of their head of department;

II. – The agents mentioned in I are authorised and sworn in under the conditions laid down in articles R. 1312-4 to R. 1312-7 of this code.

III. – The agents mentioned in the fourth paragraph of article L. 3115-1 may be authorised within the limits of their competence to carry out the tasks mentioned in 1°, 2° and 3° of article R. 3115-4 by order of the Prefect.

The manager of the entry point submits to the Prefect the list of agents likely to be authorised, as well as the nature of the tasks likely to be entrusted to them.

Entry point staff may only be appointed if they meet the following conditions:

a) They are entitled to their full rights as a citizen and have fulfilled any obligations imposed on them by the French National Service Code;

b) They have not been convicted of a criminal offence that has become irrevocable and is incompatible with the performance of their duties.

IV. – The officers controlling military entry points, military means of transport and means of transport specifically chartered by the military authority mentioned in article L. 3115-1 are authorised by order of the Minister of Defence. They may carry out health inspections of military means of transport and any means of transport serving a military port or airfield as defined in article R. 3115-15-1 and issue the certificates mentioned in article R. 3115-29 without any notion of territorial limits.

Article R3115-5

I. – Les agents mentionnés à l’article L. 3116-3 sont habilités dans les limites de leurs compétences respectives par arrêté du préfet :

1° Pour les agents de l’agence régionale de santé, sur proposition de leur directeur général ;

2° Pour les agents des services de l’Etat placés sous son autorité, sur proposition de leur chef de service ;

II. – Les agents mentionnés au I sont habilités et assermentés dans les conditions prévues aux articles R. 1312-4 à R. 1312-7 du présent code.

III. – Les agents mentionnés au quatrième alinéa de l’article L. 3115-1 peuvent être habilités dans les limites de leurs compétences pour exercer les missions mentionnées aux 1°, 2° et 3° de l’article R. 3115-4 par arrêté du préfet.

Le gestionnaire du point d’entrée soumet au préfet la liste des agents susceptibles d’être habilités, ainsi que la nature des missions susceptibles de leur être confiées.

Un agent du point d’entrée ne peut être désigné que s’il remplit les conditions suivantes :

a) Jouir de ses droits civiques et se trouver en position régulière au regard du code du service national ;

b) Ne pas avoir fait l’objet d’une condamnation pénale devenue irrévocable à une peine incompatible avec l’exercice de ces missions.

IV. – Les agents contrôlant les points d’entrée militaires, les moyens de transport militaires et les moyens de transport spécifiquement affrétés par l’autorité militaire mentionnés à l’article L. 3115-1 sont habilités par arrêté du ministre de la défense. Ils peuvent réaliser les inspections sanitaires des moyens de transports militaires et de tout moyen de transport desservant un port ou un aérodrome militaire tels que définis à l’article R. 3115-15-1 et délivrer les certificats mentionnés à l’article R. 3115-29 sans notion de limites territoriales.
