Authorisation to exceed the absolute maximum weekly working time provided for in Article L. 3121-21 is granted by the Regional Director of Companies, Competition, Consumption, Labour and Employment. It may only be granted in the event of exceptional circumstances leading temporarily to an extraordinary increase in workload.
The request for authorisation is sent by the employer to the labour inspector.
It must be accompanied by a justification of the exceptional circumstances giving rise to the request and specify the period for which authorisation is sought.
It is accompanied by the opinion of the social and economic committee, if any.
The Regional Director for Business, Competition, Consumer Affairs, Labour and Employment takes his decision in the light of a report drawn up by the labour inspector, indicating in particular whether the situation of the applicant company justifies the authorisation.
The decision specifies the scope of the authorisation and the period for which it is granted.
