Article R3121-13 of the French Labour Code

The request to exceed the limit for an entire sector of activity at national level is sent by the employers’ organisation concerned to the Minister responsible for labour.
The Minister makes his decision after consulting the employers’ and employees’ organisations that are representative in the sector in question, taking into account the economic conditions and the employment situation in the sector.

La demande de dépassement concernant l’ensemble d’un secteur d’activité sur le plan national est adressée par l’organisation d’employeurs intéressée au ministre chargé du travail.
Celui-ci prend sa décision après consultation des organisations d’employeurs et de salariés représentatives dans le secteur considéré, en tenant compte des conditions économiques et la situation de l’emploi dans ce secteur.
