Article R3121-16 of the French Labour Code

An employer who does not come under a sector covered by one of the decisions provided for in articles R. 3121-13 and R. 3121-14 may, in order to deal with exceptional situations specific to his company, request special authorisation.

This request must be substantiated and sent, together with the opinion of the social and economic committee, if any, to the labour inspector who forwards it to the regional director of companies, competition, consumption, labour and employment.

The latter takes its decision in the light of a report drawn up by the inspector indicating, in particular, whether the situation of the applicant company is such as to justify the granting of authorisation.

L’employeur qui ne relève pas d’un secteur couvert par l’une des décisions prévues aux articles R. 3121-13 et R. 3121-14 peut, pour faire face à des situations exceptionnelles propres à son entreprise, demander une autorisation particulière.

Cette demande est motivée et adressée, accompagnée de l’avis du comité social et économique, s’il existe, à l’inspecteur du travail qui la transmet au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi.

Celui-ci prend sa décision au vu d’un rapport établi par l’inspecteur et indiquant, notamment, si la situation de l’entreprise requérante est de nature à justifier l’octroi de l’autorisation.
