Article R3121-6 of the French Public procurement code

Concession contracts may be concluded without prior advertising or competitive tendering in the following cases:
1° The concession contract may only be awarded to a specific economic operator for technical or artistic reasons or for reasons relating to the protection of exclusive rights;
2° Where no applications or tenders have been received or where only inadmissible applications within the meaning of Article L. 3123-20 or unsuitable tenders within the meaning of Article R. 3124-4 have been submitted, provided that the initial terms of the contract are not substantially altered and that a report is sent to the European Commission if it so requests;
3° In the event of an emergency resulting from the impossibility for the public conceding authority, independently of its will, to continue to have the service conceded by its co-contractor or to provide it itself, on condition, on the one hand, that the continuity of the service is justified by a reason of general interest and, on the other hand, that the duration of this new concession contract does not exceed that required to implement an award procedure.

Article R3121-6

Les contrats de concession peuvent être conclus sans publicité ni mise en concurrence préalables dans les cas suivants :
1° Le contrat de concession ne peut être confié qu’à un opérateur économique déterminé pour des raisons techniques, artistiques ou tenant à la protection de droits d’exclusivité ;
2° Lorsque aucune candidature ou aucune offre n’a été reçue ou lorsque seules des candidatures irrecevables au sens de l’article L. 3123-20 ou des offres inappropriées au sens de l’article R. 3124-4 ont été déposées, pour autant que les conditions initiales du contrat ne soient pas substantiellement modifiées et qu’un rapport soit communiqué à la Commission européenne si elle le demande ;
3° En cas d’urgence résultant de l’impossibilité dans laquelle se trouve l’autorité concédante publique, indépendamment de sa volonté, de continuer à faire assurer le service concédé par son cocontractant ou de l’assurer elle-même, à la condition, d’une part, que la continuité du service soit justifiée par un motif d’intérêt général et, d’autre part, que la durée de ce nouveau contrat de concession n’excède pas celle requise pour mettre en œuvre une procédure de passation.
