Article R3122-2 of the French Labour Code

The request for authorisation to exceed the maximum daily working time, accompanied by the relevant supporting documents, the opinion of the social and economic committee, if any, and the minutes of the consultation of the trade union delegates, if any, is sent by the employer to the labour inspector.

If there is no trade union delegate or social and economic committee, the request must be accompanied by a document attesting to the fact that the employees have been informed in advance.

Article R3122-2

La demande d’autorisation de dépassement à la durée maximale quotidienne de travail, accompagnée des justifications utiles, de l’avis du comité social et économique, s’il existe, et du procès-verbal de consultation des délégués syndicaux, s’il en existe, est adressée par l’employeur à l’inspecteur du travail.

En l’absence de délégué syndical et de comité social et économique la demande est accompagnée d’un document attestant une information préalable des salariés.
