In order to assess the extent of the damage and determine whether it can be attributed to the accident, the Director of the Office will, if necessary, commission an expert opinion.

The doctor responsible for carrying out the assessment is chosen, on the basis of his or her competence in the field(s) concerned, from the national list of medical accident experts referred to in article L. 1142-10 or one of the lists established by article 2 of law no. 71-498 of 29 June 1971 relating to legal experts or, exceptionally, from outside these lists.

The Office then informs the claimant, at least fifteen days before the date of the examination, of the identity and qualifications of the doctor(s) responsible for carrying out the examination and of the expert assessment assignment entrusted to him/her.

The Office will also inform the claimant that he may be assisted by a person of his choice.

The expert sends his draft report to the claimant, who then has fifteen days to send any comments.

Within three months of the date of his appointment, the expert will send the Office his expert report including his response to any observations made by the claimant.

The Office will send this report without delay to the claimant, who has fifteen days in which to submit any observations.

Afin d’apprécier l’importance des dommages et de déterminer leur imputabilité, le directeur de l’office diligente, s’il y a lieu, une expertise.

Le médecin chargé de procéder à l’expertise est choisi, en fonction de sa compétence dans le ou les domaines concernés, sur la liste nationale des experts en accidents médicaux mentionnée à l’article L. 1142-10 ou une des listes instituées par l’article 2 de la loi n° 71-498 du 29 juin 1971 relative aux experts judiciaires ou, à titre exceptionnel, en dehors de ces listes.

L’office informe alors le demandeur, quinze jours au moins avant la date de l’examen, de l’identité et des titres du ou des médecins chargés d’y procéder et de la mission d’expertise qui lui est confiée.

L’office fait également savoir au demandeur qu’il peut se faire assister d’une personne de son choix.

L’expert adresse son projet de rapport au demandeur qui dispose alors d’un délai de quinze jours pour lui faire parvenir ses éventuelles observations.

Dans les trois mois suivant la date de sa désignation, l’expert adresse à l’office son rapport d’expertise comprenant sa réponse aux éventuelles observations du demandeur.

L’office adresse ce rapport sans délai au demandeur qui dispose d’un délai de quinze jours pour lui faire parvenir ses éventuelles observations.
