Article R3124-1 of the French Labour Code

Failure to comply with the stipulations of a company or establishment agreement or, failing that, those of a branch agreement, in accordance with the provisions of articles L. 3121-27 to L. 3121-33, and L. 3121-35 to L. 3121-40 is punishable by a fourth-class fine.

Infringements give rise to as many fines as there are employees wrongly employed.

Article R3124-1

Le fait de méconnaître les stipulations d’une convention ou d’un accord d’entreprise ou d’établissement, ou, à défaut, celles d’une convention ou d’un accord de branche, conformes aux dispositions des articles L. 3121-27 à L. 3121-33, et L. 3121-35 à L. 3121-40 est puni de l’amende prévue pour les contraventions de la quatrième classe.

Les infractions donnent lieu à autant d’amendes qu’il y a de salariés indûment employés.
