Article R3126-7 of the French Public procurement code

If the awarding authority uses electronic means, it must ensure the confidentiality and security of transactions on a computer network that is accessible in a non-discriminatory manner, in accordance with the procedures laid down by order of the Minister responsible for the economy. These take into account the characteristics of the contract, in particular the nature and value of the work or services in question.

Dans l’hypothèse où l’autorité concédante utilise des moyens électroniques, elle assure la confidentialité et la sécurité des transactions sur un réseau informatique accessible de façon non discriminatoire, selon des modalités fixées par arrêté du ministre chargé de l’économie. Celles-ci tiennent compte des caractéristiques du contrat, notamment de la nature et du montant des travaux ou services en cause.
