Article R313-16 of the French Monetary and Financial Code

When the receivable is assigned under a factoring contract, the factoring company must, as part of the notification to the assigned debtor of this assignment of the receivable, pursuant to Articles L. 313-23 to L. 313-35, include the following compulsory information on the invoice relating to the receivable assigned to it:

1° The name of the factoring company, as follows:

“The claim relating to this invoice has been assigned to…. under Articles L. 313-23 to L. 313-35 of the Monetary and Financial Code”;

2° The method of payment, as follows:

“Payment must be made by cheque, bill of exchange, notes, etc., made payable to (name of the factoring company or its agent)… and addressed to… or by transfer to account no… at ….

Lorsque la créance est cédée en vertu d’un contrat d’affacturage, la société d’affacturage doit, dans le cadre de la notification au débiteur cédé de cette cession de créance, en application des articles L. 313-23 à L. 313-35, faire figurer sur la facture afférente à la créance qui lui a été cédée, les mentions obligatoires suivantes :

1° Le nom de la société d’affacturage, comme suit :

” La créance relative à la présente facture a été cédée à… dans le cadre des articles L. 313-23 à L. 313-35 du code monétaire et financier ” ;

2° Le mode de règlement, comme suit :

” Le paiement doit être effectué par chèque, traite, billets, etc., établi à l’ordre de (nom de la société d’affacturage ou de son mandataire)… et adressé à… ou par virement au compte n°… chez….
