Article R321-15 of the French Code of civil enforcement procedures

Unless his eviction is ordered, the debtor retains the use of the seized property provided that he does not perform any material act likely to reduce its value, on pain of damages and without prejudice, where applicable, to the penalties provided for inarticle 314-6 of the French Criminal Code.

If the circumstances justify it, the execution judge may, at the request of the pursuing creditor or the debtor, authorise the performance of certain acts on the seized property.

A moins que son expulsion soit ordonnée, le débiteur conserve l’usage de l’immeuble saisi sous réserve de n’accomplir aucun acte matériel susceptible d’en amoindrir la valeur, à peine de dommages et intérêts et sans préjudice, s’il y a lieu, des peines prévues par l’article 314-6 du code pénal.


Si les circonstances le justifient, le juge de l’exécution peut, à la demande du créancier poursuivant ou du débiteur, autoriser l’accomplissement de certains actes sur le bien saisi.
