Article R321-16 of the French Intellectual Property Code

I. – The information relating to the management of rights that a collective or independent management organisation is required to make available to each rightholder pursuant to I of Article L. 326-3, include the following:

1° The contact details that the rights holder has authorised him to use in order to identify and locate him;

2° The amount of income respectively distributed and paid to the rights holder, specifying their breakdown by category of rights managed and by type of use;

3° The period during which the use took place for which income was allocated and paid to the rights holder, unless objective reasons relating to user declarations prevent the organisation from providing this information;

4° The amount of deductions made from this income, specifying that deducted in respect of management fees on the one hand and the provisions of Article L. 324-17 on the other hand;

5° The amount of any income from the exploitation of rights which has been distributed to the rights holder but which remains due to him, regardless of the period during which it was received by the organisation.

II. – The information relating to the management of the rights referred to in III of Article L. 326-3, which the organisation is required to make available to the other management organisation with which it has a representation agreement, includes the following:

1° The amount of income from the exploitation of the rights it has respectively distributed and paid under the representation agreement, specifying their breakdown by category of rights managed and by type of use;

2° The amount of any income from the exploitation of rights that it has distributed under the performance agreement, but which remain due, regardless of the period during which they were received by the organisation;

3° The amount of deductions made from this income, specifying the amount deducted for management fees on the one hand, and the provisions of article L. 324-17 on the other hand;

4° Information on the exploitation authorisations granted or refused for the works and other protected objects covered by the representation agreement;

5° A presentation of the resolutions adopted by its general meeting that relate to the management of the rights covered by the representation agreement.

Article R321-16

I. – Les informations relatives à la gestion des droits qu’un organisme de gestion collective ou indépendant est tenu de mettre à la disposition de chaque titulaire de droits en application du I de l’article L. 326-3, comprennent les éléments suivants :

1° Les coordonnées que le titulaire de droits l’a autorisé à utiliser afin de l’identifier et de le localiser ;

2° Le montant des revenus respectivement répartis et versés au titulaire de droits, en précisant leur ventilation par catégorie de droits gérés et par type d’utilisation ;

3° La période au cours de laquelle a eu lieu l’utilisation pour laquelle des revenus ont été répartis et versés au titulaire de droits, à moins que des raisons objectives relatives aux déclarations des utilisateurs n’empêchent l’organisme de fournir ces informations ;

4° Le montant des déductions effectuées sur ces revenus, en précisant celui prélevé au titre des frais de gestion d’une part et des dispositions de l’article L. 324-17 d’autre part ;

5° Le montant des éventuels revenus provenant de l’exploitation des droits qui ont été répartis au titulaire de droits mais qui lui restent dus, quelle que soit la période au cours de laquelle ils ont été perçus par l’organisme.

II. – Les informations relatives à la gestion des droits mentionnées au III de l’article L. 326-3 que l’organisme est tenu de mettre à la disposition de l’autre organisme de gestion avec lequel il est lié par un accord de représentation, comprennent les éléments suivants :

1° Le montant des revenus provenant de l’exploitation des droits qu’il a respectivement répartis et versés au titre de l’accord de représentation, en précisant leur ventilation par catégorie de droits gérés et par type d’utilisation ;

2° Le montant des éventuels revenus provenant de l’exploitation des droits qu’il a répartis au titre de l’accord de représentation, mais qui restent dus, quelle que soit la période au cours de laquelle ils ont été perçus par l’organisme ;

3° Le montant des déductions effectuées sur ces revenus, en précisant celui prélevé au titre des frais de gestion d’une part, et des dispositions de l’article L. 324-17 d’autre part ;

4° Des informations sur les autorisations d’exploitation octroyées ou refusées pour les œuvres et autres objets protégés couverts par l’accord de représentation ;

5° Une présentation des résolutions adoptées par son assemblée générale qui portent sur la gestion des droits couverts par l’accord de représentation.
