Article R321-28 of the French Intellectual Property Code

To carry out the task mentioned in 1° of Article L. 327-1, the Enforcement Board shall draw up its annual work programme on a proposal from its Chairman. An inspection not provided for in this programme may be initiated by the Board on the proposal of the Chairman.

The decision to carry out an inspection is notified by registered letter to the body that is the subject of the inspection before any inspection is carried out at that body.

The request for documents and information is sent to the inspected body by letter setting the deadline for responding. This deadline may not be less than thirty days.

The supervisory board shall take all measures to ensure that the inspection operations are carried out in such a way as to preserve the secrets protected by law for the benefit of the body.

Pour l’exercice de la mission mentionnée au 1° de l’article L. 327-1, le collège de contrôle arrête son programme annuel de travail sur proposition de son président. Un contrôle non prévu par ce programme peut être diligenté par le collège sur proposition du président.

La décision de procéder à un contrôle est notifiée par lettre recommandée à l’organisme qui en fait l’objet avant toute opération de contrôle auprès de lui.

La demande de documents et d’informations est adressée à l’organisme contrôlé par lettre fixant le délai imparti pour y répondre. Ce délai ne peut être inférieur à trente jours.

Le collège de contrôle prend toutes dispositions pour que les opérations de contrôle s’effectuent en préservant au bénéfice de l’organisme les secrets protégés par la loi.
